The terms and conditions listed below are expected to have been carefully read and understood by all website users.

"We," "us," and "our" refer to Ready to Print Pty Ltd in these terms and conditions. Ready to Print Pty Ltd and readytoprint.com.au have been used interchangeably in below terms and conditions, both refer to same company.

All visitors to this website acknowledge and accept that access to the accompanying terms and conditions as well as any applicable laws govern their usage of the website.

Kindly refrain from using this site if you do not accept these terms and conditions. You agree to be governed by the updated terms and conditions when you this website after we make changes to this notice, which we retain the right to change at any time.

For this reason, we advise you to read these terms and conditions each time you access our website.

About this website

1. License: Users are granted a limited license to access and make use of this website but may not download (other than page caching) or modify it, or any portion of it, except with express written consent of Ready to Print Pty Ltd

2. User Submissions: By submitting any content (such as reviews, comments, or suggestions) to Ready to Print , you grant Ready to Print a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to (a) use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media and (b) use the name that you submit in connection with such content.

Policy for Returns and Refunds

Once the order is completed and/or dispatched, there are no refunds possible due to the nature of the product.

Written claims for shortages, damages, or defects must be submitted within seven (7) business days after the merchandise's receipt.

Only orders that were handled wrongly will be replaced.

Only once the returned goods have been received will the order be replaced.

If it turns out that the buyer mistreated or mishandled the order, or if the buyer used part of the order and is returning that portion of the order, we won't replace the order.

Refunds and Cancellations

Ready to Print Pty Ltd does not issue refunds for orders that were cancelled or dispatched during the order processing process.

A $50 administrative fee will be charged if the purchase is cancelled after the proof has been requested and authorised (before it is sent to production).

Reservations

Ready to Print Pty Ltd has the right to accept or reject any order. Without providing a reason, we reserve the right to refuse any order at any moment. Additionally, even after we receive the order, we have the right to alter the pricing at any moment which will be communicated to the customer .

Delivery and Pick Ups

On the buyer's behalf, Ready to Print Pty Ltd will make shipping arrangements with the carrier.

The cost of shipping and handling will be entirely borne by the buyer. Ready to Print Pty Ltd disclaims all liability for any loss, damage, or delivery delay incurred while the order is in the hands of the shipping carrier.

All the invoices must be paid off before attempting to pick up the goods. You are required to sign a pick up docket upon collecting the goods. Please make sure that if you are arranging a pickup courier this has already been done and goods are ready for pick up .We can not be held responsible for any delays in getting goods ready for pick up if above process hasn’t been completed.

Property entrusted to Ready to Print Pty Ltd

When a customer leaves property in Ready to Print Pty Ltd’s care without giving clear instructions about what to do with it, Ready to Print Pty Ltd’s has three (three) months to dispose of or sell the item and keep the sale proceeds as payment for handling and holding the property.

Magnetic and electronic media

All of the discs, cassettes, compact discs, and other media that Ready to Print Pty Ltd uses to store data in order to fulfil the order are its property, excluding media supplies provided by the customer. The client cannot demand that Ready to Print Pty Ltd provide any data that has been saved in this way. Should Ready to Print Pty Ltd provide any such developed or stored data, Ready to Print Pty Ltd has the right to charge the customer for that data.

Electronic data storage

: After the order is fulfilled, Ready to Print Pty Ltd will not be in charge of keeping any data on discs, cassettes, compact discs, or other media. Ready to Print Pty Ltd may charge for storing such data if it decides to do so.

Credits

Any offer of credits that is not redeemed within ninety (90) days will be ruled invalid. Ninety-day workdays.

Modification

Ready To Print Pty Ltd will only accept requests for revisions made in writing ; informal requests will not be accepted.

Orders won't be completed unless the customer emails or faxes a confirmation of the artwork. The printing schedule will change depending on when the artwork is confirmed.

Competition and Consumer Act 2010 (Cth) Compliance

Fair Trading: Our business operates in accordance with the Competition and Consumer Act 2010 (Cth) and is committed to fair trading practices and consumer protection.

Consumer Guarantees: Under the Australian Consumer Law (ACL), our goods and services come with guarantees that cannot be excluded under the ACL. For example, our goods and services are of acceptable quality, fit for purpose, and match their descriptions. Customers are entitled to a replacement or refund for major failures and compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Limitation of Liability: Nothing in these terms and conditions purports to modify or exclude the conditions, warranties, and undertakings, and other legal rights under the ACL that cannot be modified or excluded. Our liability is limited to the maximum extent permissible under the ACL.

Unfair Contract Terms: We do not use unfair contract terms that may be declared void under the ACL.

Notices:Any notices pursuant to the ACL should be directed to our company's appointed representative at the address specified in the "Contact Us" section of this website.

Compliance:We are committed to complying with our obligations under the ACL, and if you have any concerns or queries about your rights or our obligations, please contact us.

General Disclaimer

Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.

Subject to this clause, and to the extent permitted by law:

(a) all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded
(b) We will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the products, services or these Terms (including as a result of not being able to use the products, services or the late supply of the products or services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

You bear all liability for using the Services and the Website.

All content on the Website and the Services is provided to you on an 'as is' and 'as available' basis, without any warranty or condition of any kind. The affiliates, directors, officers, employees, agents, contributors and licensors of Ready to Print Pty Ltd do not make any express or implied representation or warranty regarding the services or any products or services offered (including those mentioned on the Website).

This includes, but is not limited to, any potential loss or damage you may experience as a result of the following:

(a) inability to perform, mistake, omission, interruption, deletion, defect, and inability to correct defects; inability to operate, transmit, or deliver; computer virus or other harmfu l component; data loss; communication line failure; illegal activity by third parties; or theft, destruction, alteration, or unauthorised access to paperwork.
(b) any information on the Website or Ready to Print appropriateness, or currency of such information.
(c) costs incurred as a result of you using the Website, our services or any of the products of Ready to Print.

Liability restrictions

Regardless of how it arises, including in contract, tort (including negligence), in equity,under statute, or otherwise, our whole liability arising out of or in connection with the Servicesor these Terms will not exceed the resupply of the services or products to you.
You specifically acknowledge and agree that, regardless of how the damage was caused or the theory of liability applied, Ready to Print Pty Ltd, its affiliates, workers, agents, contributors, and licensors will not be held accountable to you for any direct, indirect, incidental, special consequential, or exemplary damages that you may suffer.
This covers, among other things, any loss of earnings (whether realised directly or indirectly), any harm to a company's reputation or goodwill, and any other intangible loss.

Typographic Mistakes

Ready to Print Pty Ltd retains the right to reject or cancel any orders placed for products listed at an inaccurate price in the event that a product is inadvertently listed at a wrong pricing.
Regardless of whether the transaction has been validated and your credit card has been charged, Ready to Print pty Ltd retains the right to reject or cancel any such orders. Ready to Print will credit your credit card account with the amount of the wrong pricing if your order is cancelled after your credit card has already been charged for the purchase.

Usage of the Site

Harassment of any kind on the site is strictly prohibited, including through chat, email, and the use of profane or abusive language.
It is forbidden to impersonate someone on the internet, including other members or guests, Ready to Print Pty Ltd employees, hosts, or representatives.
Any content that could constitute or encourage a criminal offence, violate someone else's rights, give rise to liability, be libellous, defamatory, obscene, threatening, invading of privacy or publicity rights, abusive, illegal, or otherwise objectionable may not be uploaded to, distributed through, or published through the website.
It is prohibited for you to utilise or upload commercial content to our website.

Indemnification

You agree to indemnify, defend, and hold harmless Ready to Print , its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable solicitors’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

We may include links to external websites on readytoprint.com.au in an effort to give our users more value.
Nevertheless, even if the third party is connected to readytoprint.com.au, readytoprint.com.au has no control over these linked websites, each of which is independent of readytoprint.com.au and has its own privacy and data collection policies.
You enter these linked sites at your own risk and do so simply for your convenience. Any connection from our website to another website does not indicate that we approve of, support, or encourage the content or products offered by the website's operator. Please do not link to our website.
If we learn of any such linkage, we reserve the right to give you notice.

Delivery Procedures

Depending on the kind of product and order amount, we offer different delivery periods for our custom printed items. After the approval of your artwork proof, there is a FAQ part on each product page that details how long it will take to get your items ready. We accept artwork only until 5 p.m. to guarantee that it starts production the next day. Our production starts the first working day after your acceptance of the artwork proof. When the products are shipped, you become the owner of all risk of loss or damage.

Your Secrecy

We uphold the national privacy principles set forth by the Privacy Act 1988 (Commonwealth) and protect the privacy and confidentiality of the information you supply. We ask that you carefully read our privacy policy.
By sending us an email, you can amend your information at any time. Our secure server safeguards all the information we get from its clients. Before being delivered to us, all client information is encrypted using our secure server software.
Additionally, every client record we gather is protected from unauthorised access or use. We don't keep credit card information on file on our servers.

Clause excluding unenforceable terms

Any clause or term that, in accordance with the applicable statute, would be unlawful, void, or unenforceable in any State or Territory will not apply there and will be interpreted as having never been a part of these terms and conditions.
This agreement will be completely enforceable and include such a clause in any other State or Territory where it is lawful and enforceable.
The whole enforceability and construction of the remaining clauses in these terms and conditions shall be unaffected by the deemed removal of any term under this paragraph.

Unexpected Events.

We may end this Agreement by providing you with at least seven (7) days' notice if a Force Majeure event results in delays lasting longer than thirty (30) days. Any event, situation, or decision that we could not have reasonably controlled is referred to as "force majeure."

Regulatory Authority

The laws of New South Wales shall govern and be applied to the interpretation of these terms and conditions. You agree to submit to the jurisdiction of those courts for the resolution of any claims made by either party against the other arising out of these terms and conditions, and such claims shall be heard in New South Wales.
In the event that any of the terms and conditions are declared invalid by any law, such provisions will be modified, narrowed, interpreted, or otherwise changed only to the extent required to make them legally binding.
The invalid clause may be removed from these terms and conditions if necessary, but the remaining provisions will still be in full force and effect.

GRAPHIC DESIGING

Content: We are not in charge of creating or typing any text content. We can quote you a different estimate if you would like us to write fresh content or enter text. Graphic files should be provided in a digital, editable vector format. Digital photos in high-resolution format should be provided by you. In the event that you decide to purchase stock photos, we can recommend stock libraries. We may send you a separate estimate if you would like us to look for pictures for you.

Quotation: Based on everything we've talked about, including any interaction via phone, email, or in person, we've created the pricing quote. We are accountable exclusively for the things that we have decided upon. Not included in the project scope or stated cost are items that were not considered or agreed upon. You, the client, will be responsible for additional billable time at our designer’s hourly rate.

Revisions: ONCE THE CONCEPT OF ARTWORK IS ACCEPTED BY THE CLIENT, ONLY 2 SET OF CHANGES ARE ENTERTAINED. FURTHER CHANGES will be billed separately. Revisions cannot include completely new, unagreed-upon elements. We’re happy to be flexible. If you want to change your mind or add anything new, that won’t be a problem, as we’ll provide a separate estimate for that. Should you request additional revisions beyond what is included or that exceed the allocated time, you will receive an email notification from us requesting a confirmation that you wish to proceed with said revisions and agree that you will be charged separately. After we have received your confirmation, we will proceed.
If giving changes in the menu you are requested to send them all together, our designers may point out if the requested work goes beyond the scope of what was quoted to you and needs requoting.

Allowances: You’re responsible for the cost of any outside paid assets. This includes, but is not limited to; stock images, and premium fonts. In addition, we cannot be held liable for any third-party photos, recommended or otherwise.

Payment Schedule: Whether you choose to finish the project including installation or not , you are responsible for the prices quoted to you for the graphic designing.

Copyrights: You guarantee that all elements of text, images, or other artwork you provide are either owned by yourself or that you’ve obtained permission to use them. Then, when your final payment has cleared, You’ll own the visual elements that we create for this project. We’ll give you finished files, and you should keep them somewhere safe, as we’re not required to keep a copy. You own all elements of text, images, and data you provided, unless someone else owns them. We love to show off our work and share what we’ve learned with other people, so we reserve the right, with your permission, to display and link to your project as part of our portfolio and to write about it on websites, in magazine articles, and in books.

Liability: We will work tirelessly to create incredible designs for you, but we do not take responsibility for any sales, income, or other outcomes that may arise from you using our products or services , whether they are direct, indirect, or incidental. Even though you have informed us of potential damages, we are unable to guarantee that our work will be error-free, and as a result, we cannot be held accountable to you or any other person for losses, including lost savings, profits, or other incidental, consequential, or special damages. This agreement is not reversible and is a legally binding contract.

Proof Reading: If we are creating artworks for you , we wont print until final artwork approval is given by you .You are responsible for Proofing & Approving all products created by us for you. Please check all aspects of proof, including spellings, names, phone numbers, graphics and grammatical errors. In case of wrong printing done due to above errors, client holds all the printing cost of the artworks.

Timelines and Graphic Designing:Graphic Design is a time consuming process, as much as we work on the timelines and like to meet and beat them we would like our clients to know that time taken in giving artwork approval will have direct impact on when we can have the finished product ready. Not giving response to artworks sent to you will also affect the time taken for us to get the final product ready. Every product is different and the time taken to get them ready is different too.
